These Terms & Conditions govern your access to and use of the Nio Far website and your purchase of products through our online store.

By accessing our website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use the website or place an order.

1. ABOUT NIO FAR

Nio Far is a Senegalese wearable art brand founded by designer and artist Milcos.

Nio Far creates limited and handcrafted pieces inspired by African cultural research, craftsmanship, contemporary design and storytelling.

Throughout these Terms & Conditions, “Nio Far,” “we,” “us” or “our” refers to Nio Far by Milcos and the entity operating this website.

“You” or “your” refers to the person accessing the website or purchasing our products.

2. USE OF THE WEBSITE

You may use this website for lawful purposes and in accordance with these Terms & Conditions.

You agree not to:

  • use the website for fraudulent or unlawful purposes;

  • attempt to gain unauthorized access to the website or its systems;

  • reproduce, copy or commercially exploit our content without permission;

  • interfere with the security or operation of the website;

  • use automated systems to collect content, images, product information or other materials without our prior written permission.

We reserve the right to restrict or terminate access to the website where necessary to protect the website, our business or other users.

3. PRODUCTS

Nio Far creates handcrafted and often limited-edition pieces.

Because many of our products are handmade, slight variations in texture, color, stitching, finishing or material may occur. These characteristics are part of the nature and authenticity of handcrafted production and should not necessarily be considered defects.

Product images are provided for illustration. Colors may vary slightly depending on your screen or device.

Where a product is described as limited edition, the available quantity may be restricted and may not be reproduced once sold out.

We reserve the right to modify, discontinue or limit the availability of any product at any time.

4. PRODUCT AVAILABILITY

All products are subject to availability.

Adding a product to your shopping cart does not guarantee that the product will remain available.

In the event that an item becomes unavailable after you have placed an order, we will contact you and offer an appropriate solution, which may include a refund of the unavailable item.

5. PRICES

All prices displayed on the website are stated in the currency indicated at checkout.

Prices may change at any time without prior notice. Any price change will not affect an order that has already been confirmed and paid for, except where an obvious pricing error has occurred.

Unless otherwise stated, prices do not necessarily include:

  • shipping costs;

  • customs duties;

  • import taxes;

  • local VAT or other taxes that may apply in the destination country.

International customers are responsible for any customs duties, import taxes or other charges imposed by their country of destination, unless explicitly stated otherwise at checkout.

6. ORDERS

When you place an order, you are making an offer to purchase the selected products.

After placing your order, you will receive an order confirmation by email. This confirmation acknowledges that we have received your order but does not necessarily constitute acceptance of the order.

An order is considered accepted once we confirm its processing and/or dispatch.

We reserve the right to refuse or cancel an order in circumstances including:

  • product unavailability;

  • suspected fraudulent activity;

  • incorrect pricing or product information;

  • payment authorization failure;

  • shipping restrictions;

  • technical errors affecting the website or checkout process.

If we cancel a paid order, we will refund the amount paid for the cancelled order or affected item.

Payment must be completed through the payment methods made available on the website.

By submitting payment information, you confirm that you are authorized to use the payment method provided.

Payment processing may be handled by third-party payment providers. Nio Far does not directly store complete payment card information where payment processing is handled by these providers.

8. SHIPPING & DELIVERY

We ship from Senegal to selected destinations.

Available shipping methods, delivery estimates and shipping costs will be displayed during checkout where available.

Delivery times are estimates and are not guaranteed unless expressly stated otherwise.

Delays may occur due to:

  • customs processing;

  • international transportation;

  • weather or other events outside our control;

  • incorrect or incomplete delivery information;

  • local postal or courier services.

Once an order has been handed over to the shipping carrier, tracking information may be provided where available.

You are responsible for providing accurate delivery information. Nio Far cannot be held responsible for delays or failed deliveries resulting from incorrect or incomplete information supplied by the customer.

9. CUSTOMS & IMPORT DUTIES

For international orders, the destination country may impose customs duties, import taxes or other fees.

Unless explicitly stated otherwise at checkout, these charges are the responsibility of the customer.

Nio Far cannot guarantee the amount of customs duties or taxes that may be charged by the destination country.

Customers are responsible for ensuring that the products they order may legally be imported into their country.

10. RETURNS & EXCHANGES

We want you to be satisfied with your Nio Far piece.

Unless otherwise stated for a specific product, eligible items may be returned within 14 days of delivery, provided that:

  • the item has not been worn or used;

  • the item is in its original condition;

  • all original packaging, labels and accessories are included;

  • the item has not been damaged after delivery.

Please include your order number and the reason for your return.

Return shipping costs are generally the responsibility of the customer unless the item received is defective, damaged upon arrival or incorrect.

11. REFUNDS

Once a returned item has been received and inspected, we will notify you whether the return has been approved.

Approved refunds will be issued using the original payment method, unless otherwise agreed.

Original shipping costs may be non-refundable where permitted by applicable law.

The time required for a refund to appear in your account may depend on your bank or payment provider.

12. DAMAGED OR INCORRECT ORDERS

If your order arrives damaged, defective or contains an incorrect item, please contact us as soon as possible after delivery.

13. HANDCRAFTED PRODUCTS

Nio Far pieces are created through a combination of design and craftsmanship.

Variations in materials, stitching, texture, color and finishing may occur from one piece to another.

These variations are part of the handmade nature of our products and contribute to the individuality of each piece.

Where a product uses reclaimed, recycled or naturally variable materials, differences between individual pieces may be expected.

14. INTELLECTUAL PROPERTY

All content appearing on this website, including but not limited to:

  • Nio Far's name and logo;

  • product designs;

  • photographs;

  • videos;

  • illustrations;

  • texts;

  • graphics;

  • collections;

  • artistic concepts;

  • visual identity;

  • trademarks;

  • website design;

is owned by or licensed to Nio Far and is protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, publish, sell, license or commercially exploit our content without prior written permission.

Purchasing a Nio Far product does not transfer ownership of the intellectual property associated with its design.

15. PHOTOGRAPHS AND CONTENT SUBMITTED BY USERS

If you voluntarily submit photographs, reviews, comments or other content to Nio Far, you confirm that you have the right to provide that content.

By submitting content, you grant Nio Far permission to use it for purposes related to the promotion and communication of the brand, subject to applicable law.

We reserve the right to remove content that is unlawful, offensive, misleading or otherwise inappropriate.
